DOMA Deemed Unconstitutional

[caption id="attachment_51391" align="aligncenter" width="607" caption="Getty Images"][/caption]A federal appeals court in Boston today ruled that the Defense of Marriage Act, which defines marriage as a heterosexual union between a man and a woman, is unconstitutional.

A group of plantiffs in Boston challenged the act, saying that by denying Social Security and other benefits to homosexual couples, whose unions are legal in Massachusetts, the act violated their constitutional rights.

“The denial of federal benefits to same-sex couples lawfully married does burden the choice of states like Massachusetts to regulate the rules and incidents of marriage,” the appeals judges stated in their opinion.

The court ultimately decided that by being forced to discriminate against same-sex couples on a state level due to a federal law the act, specifically Section 3, was unconstitutional.

It is very likely that the decision will now head to the Supreme Court.
