NYPD Reportedly Attacked Gay Man Having Asthma Attack, Then Arrested Him For Disorderly Coduct

James Rolkiewicz says he was "punched, kicked... handcuffed and choked until he lost consciousness."

James Rolkiewicz, a gay man from Staten Island, is filing a $6 million lawsuit against the NYPD after a police officer allegedly beat him up and called him a "f*cking f*ggot" while he was attempting to recover from an asthma attack.

Rolkiewicz alleges that he was walking around Greenwich Village last September when he started to feel an attack coming on. He sat on the steps of Greenwich House Music to rest and find his inhaler, when a patrol car pulled up and two officers stepped out.

He claims the cops started cursing at him, calling him a "f*cking f*ggot," while demanding he show them identification.

As Rolkiewicz fumbled to find his ID, one of the officers reportedly grabbed him and "repeatedly smashed his face and head into the hood" of the patrol car, according to the lawsuit.

Papers filed in court add that Rolkiewicz was "brutally handled, punched, kicked... handcuffed and choked until he lost consciousness."

He was then arrested him, allegedly without being read his rights, and kept in custody for two days.

Rolkiewicz says that, when he was finally brought before a judge, his court-appointed attorney pressured him to confess to disorderly conduct—otherwise, he'd be prosecuted for assault on a police officer.

In response to the suit, the NYPD Law Department has only commented, "We are reviewing the complaint."
