Judge Rules Missouri Must Recognize Gay Marriages Performed Out-Of-State

A Missouri Circuit Court judge ruled today that same-sex marriages legally performed in other states must be recognized in Missouri.

In his decision, Judge J. Dale Youngs wrote:

This case presents an issue of first impression in Missouri: Under the Constitutions of the United States and State of Missouri, must defendants recognize out-of-state marriages between same-sex couples that are legal in the jursidiction in which they were contracted—just as it recognized all other similarly valid out-of-state marriages?

The answer is yes.

The case, Barrier v. Vasterling, involved eight same-sex couples who wed elsewhere seeking recognition of their marriages in the Show Me State. "Couples in America should not have to play ‘now you’re married now you’re not’ as they travel, work, or move across state lines," said Freedom to Marry National Campaign Director Marc Solomon.

Since June 2013, when the Supreme Court ruled against the Defense of Marriage Act, more than 40 cases have been ruled in favor of marriage equality.
