Four Men Charged in Brutal Beating of a Gay Couple in Austin

Prosecutors are pursuing a hate crime finding.

Four men have been arrested in connection with an attack on a gay couple who were leaving a bar in Austin, Texas last month.

Frank Macias was arrested and charged Tuesday morning with two counts of felony aggravated assault, and confessed that he, his brother, Miguel Macias, and two other men assaulted the couple, Tristan Perry and Spencer Deerhing, KXAN reports.

The other two men who have been arrested and charged are Quinn O'Connor, and Kolby Monnel.

Perry and Deerhing, who had to be sent to the hospital to treat their injuries, were walking near Third Street and Colorado Street on January 19, when, they told police, a man walked passed and yelled a homophobic slur. When the couple turned around and asked him what he said, they report he continued calling them an anti-gay slur, while motioning to the other three men he was with, who then all began attacking them.

"According to Tristan, he sustained a fractured nose, bruised orbital eye socket, concussion, chipped front teeth, lacerations, stitches and bruised ribs. According to Spencer, he sustained a concussion, injuries to his neck and bruising," according to police, in a court affidavit.

One of the suspects then threatened a witness, who called 911. Surveillance footage captured the attack and images of the attackers, but it was an anonymous tip that led to the arrests.

The four men now each face two counts of second-degree felony aggravated assault, and are being held on collective $300,000 bonds.

Travis County District Attorney Margaret Moore said prosecutors will pursue a hate crime finding on top of those charges, according to KXAN, which could mean a sentencing range of five to 99 years.

According to FBI statistics, hate crimes rose 17% in the United States in 2017, the most recent year on record. There hadn't been a single-year increase that large since 2001.
