Senators Call for Investigation of Roxsana Hernández's Death Under ICE

The transgender asylum seeker died last year under questionable circumstances at an ICE facility in New Mexico.

Pressure is mounting for the United States Immigration and Customs Enforcement (ICE) to answer for the death of a transgender asylum seeker who passed away while in federal custody last year.

Senators Kamala Harris of California and Richard Blumenthal of Connecticut are calling for a special counsel to investigate the suspicious death of Roxsana Hernández at Cibola County Correctional Center in Milan, New Mexico, last May. The demand comes just days after the revelation that the agency likely wiped video footage of the Honduran migrant’s last days in detention—evidence that could prove vital in a wrongful death claim against ICE.

“If ICE destroyed video evidence to cover up what happened to Roxsana Hernández, a transgender woman who died in their custody, then we need to know about it,” Harris, also a Democrat running for president in 2020, wrote to her followers on Twitter.

Hernández’s death has sparked nationwide protest after an autopsy commissioned by the Transgender Law Center (TLC) suggested she was abused while in custody. ICE officials report she was hospitalized after suffering pneumonia, dehydration, and complications associated with untreated HIV.

As NewNowNext previously reported, the Cibola County facility where Hernández died can house up to 60 transgender women. ICE statistics from July revealed that the agency has 135 self-identified transgender migrants in custody nationwide.

ICE media relations previously declined to comment in a statement released to NewNowNext.

“That said, absence of comment should not be construed as agreement with or stipulation to any of the allegations,” the agency added.
