South Dakota Becomes First State With Anti-Trans Bathroom Law

"Every restroom...shall be designated for and used only by students of the same biological sex."

South Dakota lawmakers passed a bill Tuesday that bans transgender students from using bathrooms most in accordance to their gender identity.

The bill, House Bill 1008, passed the state's house of representatives earlier this month and cleared the senate this week by a vote of 15-20.

If signed by Governor Dennis Daugaard, HB 1008 would be the first statewide law to ban transgender students from using bathrooms that most accurately reflect their gender identity.

From the bill itself:

"Every restroom, locker room, and shower room located in a public elementary or secondary school that is designated for student use and is accessible by multiple students at the same time shall be designated for and used only by students of the same biological sex."

The bill goes on to define "biological sex" as "the physical condition of being male or female as determined by a person's chromosomes and anatomy as identified at birth."
