Trans Inmate Sues Illinois, Seeking Transfer to Women’s Prison

She says she has suffered physical, verbal, and sexual abuse for over 15 years.

A transgender inmate is suing the Illinois’ Department of Corrections, arguing it hasn't done enough to protect her from abuse. She is also requesting a transfer to a female prison.

Lawyers for the MacArthur Justice Center and Uptown People’s Law Center filed suit on Tuesday on the woman's behalf, who is referred to by the pseudonym "Tay Tay" in the filing, the AP reports.

Tay Tay is serving a sentence for armed robbery, and has been an inmate for over 15 years. Attorney Sheila Bedi said her client has been subject to taunts and assaults, including rape by a cellmate, due to the "IDOC’s systemic failure" to protect transgender people under its supervision.

At the end of last year, trans inmate Strawberry Hampton won her legal battle against the IDOC, leading to a transfer to a women's prison as she had requested, after a previous request was denied, exposing her to a brutal attack by four fellow inmates.

The Trump administration has rolled back Obama-era protections that had required placement of inmates to be decided on a case-by-case basis, and instructed prison officials to "use biological sex as the initial determination for designation."

Over 100 civil rights groups signed onto a letter last year warning that the transgender inmates would suffer harm under the new policy.
